  8. Our responsibility for loss or damage suffered by you

    Whether you are an organisation or a customer:

    • We do not exclude or limit in any way our liability to you where it would be unlawful to do so. This includes liability for death or personal injury caused by our negligence or the negligence of our employees, agents or subcontractors and for fraud or fraudulent misrepresentation.
    • Different limitations and exclusions of liability will apply to liability arising as a result of the supply of any products to you, which will be set out in our purchase terms and conditions.
    • We shall not be liable for any losses or damages including without limitation losses or damages relating to viruses that may infect your computer equipment or other property on account of your access to, use of, or browsing in our site or your downloading of any materials, data, text, images, video, or audio from the site.
    • You agree not to use our site for any commercial or business purposes, and we have no liability to you for any loss of profit, loss of business, business interruption, or loss of business opportunity.
  9. We are not responsible for viruses and you must not introduce them

    We do not guarantee that our site will be secure or free from bugs or viruses.

    You are responsible for configuring your information technology, computer programmes and platform to access our site. You should use your own virus protection software.

    You must not misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material that is malicious or technologically harmful. You must not attempt to gain unauthorised access to our site, the server on which our site is stored or any server, computer or database connected to our site. You must not attack our site via a denial-of-service attack or a distributed denial-of service attack. By breaching this provision, you would commit a criminal offence under the Computer Misuse Act 1990. We will report any such breach to the relevant law enforcement authorities and we will co-operate with those authorities by disclosing your identity to them. In the event of such a breach, your right to use our site will cease immediately.

  10. We are not responsible for viruses and you must not introduce them

    You may link to our home page, provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it.

    You must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

    You must not establish a link to our site in any website that is not owned by you.

    Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page.

    We reserve the right to withdraw linking permission without notice.

  11. Which country's laws apply to any disputes?

    Please note that these terms of use, their subject matter and their formation, are governed by English law. You and we both agree that the courts of England and Wales will have exclusive jurisdiction.

In these terms and conditions of entry (“Entry Conditions”), the following definitions shall apply: 

Site: The Cornish Seal Sanctuary or any part of it.

SEA LIFE TRUST/ ‘Us’/ ‘We’/ ‘Our’: SEA LIFE TRUST Ltd.: Our company registration number is 10833916, our charitable registration number is 1175859 and our registered office is at Link House, 25 West Street, Poole, Dorset, England, BH15 1LD;

Ticket:  A valid ticket allowing the holder entry to the Site.

Guests are admitted to this Site subject to the following Entry Conditions.  By purchasing or using a Ticket, guests agree to comply with these Entry Conditions.

All guests aged 16 and under must be accompanied by an adult aged 18 or over to visit. No child or children aged 16 and under will be admitted to the Site unless they are accompanied by an adult aged 18 years or over and such child or children whilst on Site must always remain under the control or supervision of an adult. SEALIFE TRUST reserves the right, in its absolute discretion, to change the age restrictions referred to in this condition, if any particular circumstances so require in the interests of safety and security.

Any person who does not comply with these Entry Conditions may be removed from the Site by SEA LIFE Trust personnel or police officers, without any right to a refund.  This is without prejudice to any claim that we may have against such a person or arising out of their actions.  Whilst inside the Site, all guests must comply with any reasonable instructions given to them by SEA LIFE TRUST personnel or any third party instructed on our behalf. Acting reasonably, SEA LIFE TRUST reserves the right to vary these Entry Conditions at any time without prior notice.  By entering the Site, guests accept that they have a duty to take reasonable steps to ensure their own safety, taking into account any personal medical conditions.  All persons in and around the Site should behave in a safe manner at all times.

For health and safety reasons (due to the topographical features of the Site), vehicles that assist with a person’s accessibility requirements are the only transport device permitted within the Site by guests, subject to availability of spaces.  For the avoidance of doubt, bicycles, hover-boards, rollerblades or similar devices are not permitted within the Site.

Our commitment to provide a service:

We will endeavour to ensure that all parts of the Site are available to guests at the Site.  However, we reserve the right, without prior notice, to close and change the programme of talks, tours and animal experiences and/or an individual part of the Sites operating hours.  SEALIFE TRUST in its absolute discretion reserves the right to close the whole or any part of the Site at any time or to restrict the number of persons having access to the Site.  The reason for any closure or restriction provided by this condition may include technical or operational reasons, capacity, inclement weather, special events or to ensure the safety and security of guests or if SEALIFE TRUST reasonably considers the circumstances so require. If any part of Site is closed for any of the reasons set out above, we reserve the right to offer substitute tickets for admission to the relevant Site on an alternative date in substitution for any other form of redress.

Tickets/admissions:

THE SITE IS PRIVATE PROPERTY. All persons entering the Site must pay for admission or hold a valid ticket. All persons under 3 years of age may enter the Site free of charge. The sale of tickets/vouchers by anyone other than SEALIFE Trust or those authorised by SEALIFE TRUST is strictly prohibited. Only persons authorised by us are permitted to sell or offer for sale any items to guests within the Site grounds. All tickets are non-transferable, not for resale and will become automatically void on any transfer for value. Tickets purchased are only valid on the date printed on the ticket, excluding tickets valid for 12-month period. Tickets valid for 12 months must be named and signed on the date of issue for validity purposes as Tickets are not transferable.  When using Tickets for admission to the Site, ID must be produced for the named person on each ticket (excluding those on child tickets); where ID is not available the named guest will be asked to reproduce their signature to confirm the validity of the ticket.  Tickets may not be valid for special events and/or for entry into certain parts of the Site and a separate admission fee may be payable in this respect. Tickets will only be exchanged or refunded if SEALIFE TRUST, in its absolute discretion, chooses to do so. For the avoidance of any doubt, pre-booked tickets are non-refundable in the event that admission is refused or relinquished for any reason referred to in these Entry Conditions. Tickets booked online will be delivered in accordance with our delivery procedure. If tickets are bought on behalf of other guests, the buyer accepts these Entry Conditions on behalf of every guest and shall ensure that these Entry Conditions are complied with by each person in the group. Tickets must be retained at all times and submitted for inspection if required by SEALIFE TRUST. 

SEALIFE TRUST will not accept responsibility for tickets which have been lost, stolen, forgotten about or for any other reasons which may have prohibited their use.

Ticket prices are inclusive of any applicable taxes and there are no surcharges.  Prices displayed on the website or subject to change without notice.

Guest Behaviour:

Unnecessary noise or any behaviour likely to cause annoyance to other guests or animals or confusion of any kind is not permitted in the Site. Smoking (including of e-cigarettes) is strictly prohibited other than in the designated smoking areas.  All attractions, amusements, transport systems and any other facilities located at the Site must only be used in accordance with the relevant operator's instructions.

Our right to remove you:

SEALIFE TRUST, acting reasonably at all times, reserves the right,  to refuse admission to the Site, ban from entry to the Site, or remove from the Site without any right to a refund any person whose presence or behaviour may affect the enjoyment and/or safety of other guests, staff or animals or who: acts in an inappropriate and/or undesirable manner whilst travelling to a Site whether by bus, coach or other means, where such behaviour has been reported to us by a reliable independent source; has been convicted of a criminal offence relating to SEALIFE TRUST, or civil unrest at SEALIFE TRUST property/attractions, which, in our opinion, is likely to affect the safety and/or enjoyment of other guests, staff or animals; uses violent, aggressive, threatening, abusive, discriminatory or insulting words or behaviour or in any way behaves in a manner which may provoke a breach of the peace; climbs or stands upon barriers, walls, exhibits or any other buildings at any Site; enters or attempts to enter any part of any Site which is a restricted or prohibited area as determined by SEALIFE TRUST. We reserve the right to initiate legal proceedings or prosecute any person who: is found damaging or defacing any part of the grounds, barriers, walls, exhibits, fabrics or buildings at any part of the Site; or has displayed any sign or visible representation of any kind which is, or could be reasonably judged to be, threatening, abusive or insulting; or has previously acted in any manner which has caused any person to report that individual to SEALIFE TRUST; or is attempting to regain admission to a Site or has been found inside any Site without a valid ticket; or has purchased or obtained any tickets or discount vouchers from a ticket tout or SEALIFE TRUST reasonably believes that they have purchased a ticket from an unauthorised source.  If any guest in breach of any of these Entry Conditions is a member of a group, then such group of individuals may also, at SEALIFE TRUST’s discretion, be denied entry or escorted from the Site without any right to a refund.

Your dress & appearance must be suitable for a family attraction:

You must wear appropriate clothing (including a top and shoes) at all times whilst at the Site. If you are wearing clothing that is indecent or likely to cause offence in any way, you will be refused entry or removed from the Site.

Parking

Vehicles are parked at the owners’ risk. We take no responsibility for damage caused to any vehicle using the car park and no guarantee is given as to the security of guests’ vehicles in the car park or any contents. Due to the topographical features of the Site, all vehicles parked must have the handbrake fully applied and must remain in gear.  No vehicles are permitted to remain in the Site outside the Site’s normal operating hours without the prior express permission of the Site. The Site retains absolute discretion as to whether such permission is granted.   A breach of this condition will be deemed to be trespassing, the vehicle will be removed and the owner shall be responsible for all consequences arising as a result of such removal.

Security and Safety

To prevent offensive weapons or dangerous articles from being brought into the Site, guests are admitted to the Site subject to the condition that, if requested to do so, they will allow themselves and/or their belongings to be searched.  It is prohibited to bring into the Site any weapons, fireworks, smoke bombs, glass bottles or other articles which may cause injury. The throwing of any article which could cause injury or affect the enjoyment of other guests or animals is strictly prohibited.  Any person found to be in possession of an article deemed to be offensive or dangerous will be immediately escorted from the Site without any right to a refund and SEALIFE TRUST reserves the right to make reports to the relevant authorities which may lead to prosecution. The consumption of alcohol is permitted only in authorised places within the Site.  Accordingly, alcohol may not be taken into the Site except with the express permission of SEALIFE TRUST and any persons found possessing alcohol, or who appear to be under the influence of alcohol may be refused admission to the Site or escorted from the Site without any right to a refund.  The use of illegal substances and/or legal highs (including, but not limited to, laughing gas) are strictly prohibited and any persons found possessing, using or who appear to be under the influence of illegal substances and/or legal highs will be refused admission or escorted from the Site without any right to a refund.

CCTV cameras are used to assist in the proper running of the Site. However, we do not make any representation as to the extent of coverage provided by the cameras. All items, belongings and other property brought into the Site by guests are at their own risk and we accept no liability for any loss or damage to such property. As such, we recommend that guests do not bring valuables to the Site.

Due to the Sites proximity to RNAS Culdrose, the Site is a no-fly zone and so drones and other flying objects are not permitted on the Site without express written permission from RNAS Culdrose and the Site.  Requests must be made in advance to seals@sealifetrust.com.

Animals

Dogs are permitted in the Site, with the exception of our Seal Hospital, Discovery Cove Play Area and inside our Café (except for assistance dogs).  They must never be left unattended anywhere within the Site.  Any other pets or animals brought to site must be under the control of the owner at all times and remain secured at all times whilst in the Site and, for the avoidance of doubt, no dogs or animals should not be left in any vehicle parked at the Site. We reserve the right to contact any relevant authority to make and be responsible for any decision in relation to any animals that are left unsupervised or that are found to be in distress.

Photography

Unless it is expressly prohibited, you are permitted to take photographs and recordings within the Site provided that these are solely for private use and are not sold or used for any commercial or public purpose.  By accepting these Entry Conditions, you acknowledge that SEALIFE TRUST may on demand have access to photographs taken and video footage captured by you and request that certain photographs and/or footage are deleted if they are deemed to be offensive to or infringe the privacy of other guests and/or staff. By accepting these Entry Conditions, you agree not to intentionally photograph and/or capture video footage of any individual without that person’s permission and you must adhere to all photography/filming restrictions in place from time to time whilst within the Site. From time to time SEALIFE TRUST or other authorised parties carry out photography and/or video recording in the Site, which may feature guests. Entry to the Site is deemed acceptance of these Entry Conditions, and you therefore agree that SEALIFE TRUST or any authorised party may use such images in perpetuity in any promotional, advertising or publicity material in any format whatsoever. You further agree that copyright in these materials rests with SEALIFE TRUST or such authorised party (as the case may be).  

SEALIFE TRUST’s Liability

SEALIFE TRUST accepts no responsibility for any loss and/or damage suffered by guests as a result of the guest's failure to comply with these Entry Conditions or any event outside SEALIFE TRUST's control (including any distress, inconvenience, anxiety or loss of enjoyment arising from the evacuation of the Site). This does not affect any guest's statutory rights or any liability of SEALIFE TRUST which cannot be excluded by law.
